Philosophy of Islamic Legal Ruling
Islamic legal rulings are all encompassing in the sense that these rulings define mortal actuality and those who cleave to these are religionists and Muslims. God says in Quran that our body corridor and we ourselves will be questioned and reckoned by God on the day of judgement, a theology and metaphysical reality of actuality which will see the emergence of a new world and a new reality. Of course veneration has no regard for final judgement or absolute justice and hence in veneration sin has a ticket to escape especially when the wrongdoers hold positions of power and influence and sweat no responsibility.
These Islamic rulings has been classified as obligatory, banned, permitted, recommended, disliked. These legal rulings address mortal empirical conditioning and when I say empirical, I mean all possible forms or models of mortal trials. In the most introductory sense, we can say these legal rulings define mortal beliefs and conduct and are normative both in their particular and collaborative situations. These rulings apply to colorful reaches of mortal beliefs and conduct in their varied conditioning similar as
• A legal ruling can be applied to sight similar as prohibition of seeing a woman, man or beast sexually unlawfully.
• A legal ruling can be applied to hearing similar as prohibition of willingly harkening to sexualized music or willingly indulging in unethical words and statements of others.
• A legal ruling can be applied to touch similar as touching a woman unlawfully.
• A legal ruling can be applied to smell similar as smelling commodity can beget death.
• A legal ruling can be applied to taste similar as eating or drinking commodity banned.
• A legal ruling can be applied to sentiment, impulse and desire similar as prohibition of asking a temporal life, rehearsing apathetic sentiment or sybaritic impulse.
• A legal ruling can be applied to belief and outlook similar as prohibition of belief in veneration or obligation of belief in patriarchy.
A legal ruling can be applied to intelligent mortal action which can be expressed in verb. This is a broader aspect and also includes models of collaborative authority similar as political, military, profitable, fiscal, legal and felonious, domestic, ritualisticetc.
Islamic legal rulings as has been bandied depend on taklif and that demands due responsibility. Similar as a person who has taklif of prayer is also rightfully responsible to supplicate or a person who has taklif of ruling is also rightfully responsible to rule or a group who has taklif of Jihad is also rightfully responsible to fight etc. So, a person who has taklif is a mukallaf and the introductory prerequisites are being adult, sapient/ intellect/ stable and capability. Depending on the type of legal ruling and the type of legal act/ belief capability will depend. Generally, capability can be internal, physical and/ or fiscal. Some scholars put being Muslim or a religionist is also a condition, but this is wrong as having faith or the act of belief in God is also itself an obligatory legal ruling. In numerous conduct therefore faith should be a condition of performance but not condition of being a mukallaf. This is because Islamic legal rulings aren't only limited to Muslim performance or adherence but alsonon-Muslim under Islamic hukm or governance. One illustration is Jizya but general principle is allnon-faith grounded laws of Islam are to be followed bynon-Muslims. One similar Islamic law is limited freedom fornon-Muslims to perform their religious acts and religious laws under Islamic rule filtered through Islamic law. “ Sludge” because for illustration theoretically .
Will Islamic law allow Aztec practice of mortal immolation as part of their religious rituals? Definitively not!? This is fasad on earth, or theoretically will Islamic law allow public sexual sybaritism as part of Cacodemonic religion or occult or necromancy religion? Definitively not as this is social moral disaster and a trouble to Islamic public security and morality.
