Kufr Akbar
This is a form of unbelief which takes a Muslim outside of Islam. This unbelief is related with rejection, denial, arrogance and pride against Sharia Law. It can do in the following circumstances:
Intransigence and Arrogance
If he doesn't rule according to what Allah has revealed out of intransigence and arrogance, he's a kaafir and has left Islaam, indeed if he doesn't deny the rule of Allaah. Intransigence and arrogance may mean negligence and turning down, as Allaah says “ Have you seen those (hypocrites) who claim that they believe in that which has been transferred down to you, and that which was transferred down before you, and they wish to go for judgement (in their controversies) to the Taaghoot (false judges,etc.) while they've been ordered to reject them. But Shaytaan wishes to lead them amiss. And when it's said to them‘ Come to what Allaah has transferred down and to the Messenger,’ see they hypocrites turn down from you (Muhammad) with aversion.” (al-Nisaa’460-61)
Sharia is Voluntary
“ O Messenger! Let not those who accelerate to fall into unbelief suffer you, of similar who say‘We believe’with their mouths but their hearts have no faith. And of the Jews are men who hear important and eagerly to falsehoods- hear to others who haven't come to you; they say,‘If you're given this, take it, but if you aren't given this, also guard!’...” (al-Maa’idah 541). He says “ Go to Muhammad ( peace be
upon him), and if he tells you that the ruling is switches, accept it, but if he commands stropping, ignore what he says. Also Allaah revealed “... And whoever doesn't judge by what Allaah has revealed, similar are the kaafiroon ( doubters)” (al-Maa’idah 544).
